The Michigan Department of Agriculture and Rural Development explains the different types of hemp and CBD products, as well as the activities that are permitted under Michigan hemp laws:

Any product derived from industrial hemp with a THC concentration greater than 0.3 percent is classified as marijuana and is regulated by the Michigan Department of Licensing and Regulatory Affairs.

CBD oil and other industrial hemp-derived products fall into several categories. Any substance that will be added to food or drink or marketed as a dietary supplement must first be approved for that purpose by the US Food and Drug Administration. The FDA has not yet approved CBD for use in food or drink, or as a dietary supplement. As a result, it is currently illegal to incorporate CBD into food or beverages, or to sell it as a dietary supplement.

The FDA considers GRAS (Generally Regarded As Safe) substances to be safe to add to food. As of 12/20/18, hulled hemp seeds, hemp seed protein, and hemp seed oil are GRAS. As of 3/29/19, CBD is not considered GRAS.

Any food production in Michigan is subject to the Michigan Food Law and the licensing requirements outlined in the law.

A license from the Michigan Department of Agriculture and Rural Development will be required to grow industrial hemp (MDARD). MDARD is in the process of developing a licensing program for growers in order to meet the requirements of both state and federal laws for interstate plant commerce.
